Much like Jackson, this claim was brought against the employer, insurance company and defense examiner. However, the plaintiff here obtained final adjudication of his claim through the WDCA process. The plaintiff went on to settle his claim via redemption, at which time he also signed a Resignation of Employment, Waiver of Seniority, and Release of all Claims. Both the employer and insurance company were dismissed from the case on a Motion for Summary Judgment based on the signed release of all claims. The matter was dismissed regarding the doctor based on a failure to state a claim under RICO.

Key Point: Notwithstanding the actual existence of a RICO claim, the Release of all Claims protected the insurance company and employer against additional employment related litigation.
